Bodo Bikes Terms and Conditions

These Terms and Conditions govern your access to and use of Bodo Bikes services, including our website, online store, social media ordering, and delivery arrangements. By browsing, placing an order, paying, or accepting delivery, you agree to these Terms.

Bodo Bikes is a service brand operated under Sicanebodo Ltd. References to “Bodo Bikes”, “we”, “us”, or “our” mean Sicanebodo Ltd trading as or providing services under the Bodo Bikes brand.

1. Who we serve and how you may use our services

You may use our services if you are at least 18 years old, or if you are acting with the authority of an organization, government office, or corporate body. If you place an order on behalf of an entity, you confirm you have authority to bind that entity to these Terms.

You agree not to misuse our platforms, attempt unauthorized access, or interfere with our systems. Unlawful access and related misconduct are addressed under Uganda’s Computer Misuse Act. (ULII)

2. Product information and availability

We sell riding gear and motorcycle related accessories, including helmets, protective wear, gloves, boots, and safety accessories.

Product descriptions, photos, specifications, sizes, certifications, prices, and availability may be incomplete, may contain errors, and may change without notice. Images are for illustration and may differ slightly from the delivered item due to packaging updates, manufacturer revisions, or batch variation.

We may correct errors and update information at any time, including after you submit an order. If a material change affects your order, we may contact you with options, including a substitution, a revised delivery timeline, or cancellation with a refund where applicable.

3. Orders and acceptance

Placing an order is an offer to buy. Your order is accepted only when we confirm acceptance by invoice, receipt, payment confirmation, dispatch notice, or written confirmation through our official channels.

We may decline or cancel an order at our discretion, including for stock unavailability, pricing errors, suspected fraud, delivery constraints, or where we cannot reasonably verify the transaction.

4. Pricing, quotations, and institutional procurement

Prices are shown in Uganda Shillings unless stated otherwise. Prices may change without notice.

For NGOs, government offices, and corporate bodies, we may issue quotations and pro forma invoices. Unless expressly agreed in writing, quotations are time limited and subject to stock, supplier pricing, and exchange rate movement.

Where your internal procurement rules apply, you are responsible for ensuring approvals, purchase orders, and receiving procedures are completed before or at delivery.

5. Payments and payment processing via DPO

We accept online payments through DPO Pay and any additional payment methods we list at checkout.

When paying online, you authorize DPO and relevant payment partners to process your transaction. We do not store full card details. Payment processing may include verification steps to reduce fraud.

Chargebacks and payment disputes: If a cardholder disputes a transaction through their bank, this may result in a chargeback. You agree to cooperate with reasonable requests for information to resolve disputes. You also acknowledge that merchants typically carry chargeback responsibility under DPO’s chargeback guidance. If we reasonably suspect fraud, we may pause fulfillment, request identity confirmation, or cancel the order.

6. Delivery within Uganda and delivery outside Uganda

We deliver within Uganda using our own delivery arrangements or third party couriers. Delivery timelines are estimates and are not guaranteed. Delays can occur due to weather, road conditions, security incidents, carrier capacity, public holidays, or verification checks.

Risk of loss: Unless otherwise agreed in writing, risk transfers to you upon delivery to your provided address, handover to your nominated recipient, or collection at a pickup point.

Delivery outside Uganda may be arranged on request. Cross border deliveries may involve additional fees, customs documentation, taxes, duties, inspections, and longer timelines. You are responsible for any destination country charges unless we agree otherwise in writing.

7. Inspection on delivery

You must inspect items promptly on delivery or collection. If packaging appears tampered with or items appear missing or damaged, notify the delivery agent immediately where possible and contact us within 48 hours with photos and your order details.

8. Returns, exchanges, and refunds

We aim to be fair, practical, and safety conscious.

Because many items are protective equipment, we may refuse returns for items that have been worn, used, altered, washed, or are not in resalable condition. For hygiene and safety reasons, certain items may be non returnable unless defective.

If you receive the wrong item, an item with a verified manufacturing defect, or an item damaged in transit, contact us within 48 hours and we will assess the case. Where appropriate, we may repair, replace, exchange, or refund in line with applicable law and practical supply constraints.

Returns must be in original condition with tags, packaging, and proof of purchase, unless the item is defective and the packaging is unavailable due to inspection.

Refunds, where approved, are processed to the original payment method where possible, or by another mutually agreed method.

Uganda’s Sale of Goods and Supply of Services Act provides key principles on sale contracts and remedies, and these Terms are intended to align with those principles while remaining practical for safety gear retail. (ULII)

9. Safety and proper use disclaimer

Our products reduce risk. They do not eliminate risk.

Motorcycle riding is inherently hazardous. Protective gear can fail, may not prevent injury or death, and must be used correctly. You are responsible for selecting the right product, correct size, correct fitting, and correct use. Where you need guidance, contact us before purchase.

Certification claims: We may provide certification information based on manufacturer documentation and supplier declarations. You are responsible for ensuring suitability for your intended use, including workplace requirements, sport rules, or organizational policies.

No professional advice: Any guidance we provide is general product guidance, not medical, legal, engineering, or occupational safety advice.

10. Limitation of liability

To the maximum extent permitted by applicable law, Bodo Bikes and Sicanebodo Ltd will not be liable for indirect losses, including loss of profit, loss of business, loss of goodwill, loss of data, or any consequential damages.

Our total liability for any claim related to an order or product will not exceed the amount you paid for the specific item or order giving rise to the claim.

We are not liable for delays or failures caused by events beyond our reasonable control, including supplier delays, transport disruptions, strikes, civil unrest, or force majeure.

11. Intellectual property

All content on our platforms, including brand names, logos, product photos we own, designs, and written content, is protected. You may not copy, reproduce, or use our brand assets without written permission.

12. Privacy and personal data

We collect and process personal data to provide services such as order fulfillment, delivery, customer support, fraud prevention, and record keeping. We process personal data in line with Uganda’s Data Protection and Privacy Act and related Regulations, including principles of lawful processing and appropriate security safeguards. (ULII)

13. Electronic records and communications

You consent to receive communications electronically, including order confirmations, invoices, receipts, and notices. Transactions and records may be concluded and stored electronically, consistent with Uganda’s Electronic Transactions Act and Electronic Signatures Act. (ULII)

14. Changes to these Terms

We may update these Terms from time to time. The version posted on our website is the current version. Changes apply from the date they are posted, and your continued use of our services indicates acceptance of the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of Uganda. Where a dispute arises, the parties will first attempt to resolve it in good faith through direct discussion. If unresolved, the dispute may be referred to competent courts or other lawful dispute resolution mechanisms in Uganda.
